The Friedkin Group’s takeover of Everton does not hinge on the decision of the New York court presiding over A-Cap’s legal dispute with Leadenhall, the Liverpool Echo reports.

According to the outlet’s website on 3 October the prospective new owners may have to alter the way they go about dealing with the debt linking the club to that case, but it wouldn’t block it altogether.

Sources have reportedly said of TFG: “They would have not come so far down the line were they not confident of clearing this hurdle.

The Friedkins agreed a deal with A-Cap to settle a £200million debt to former buyers 777 Partners, with both since accused of fraud by Leadenhall, which they both deny.

Leadenhall have questioned if the deal with TFG could amount to asset stripping while A-Cap insists it is outside the remit of an injunction set out by the court restricting their actions.

According to Paul Brown via X on 3 October there are a number of ways past this matter for TFG, but until the matter has been fully discussed and the judge rules it’s unknown if the deal will need to be altered.

If there is no regulatory danger of the judge’s decision actually derailing the takeover then it shouldn’t be a major worry for Everton.

The Friedkin’s previously abandoned their summer bid over complications relating to this case [The Athletic, 19 July] so it would be incredibly short-sighted to have returned and announced an agreement with Farhad Moshiri if this could simply bring it to a halt again.

TFG, by all accounts, have the finances to pay off the debt right now if they have to but appear to be aiming for a route out that takes longer and is easier to swallow.

At the same time, there are clearly differing interpretations of the injunction between Leadenhall and A-Cap, and by extension TFG, which creates the sort of grey area that can generate unwelcome surprises, as Everton know all too well.

The Premier League saw the club’s view of their accounting practices very differently, leader to a pair of points deductions last season, and another still hanging over them relating to disputed interest charges as part of the new stadium construction.

So the Friedkin’s will need to very confident in their view that the takeover can go ahead whatever the judge decides here, and by the looks of things they do.
